Lease Origination Process

Non-Resident Taxation for Rental Income

For international real estate investors in Toronto, reporting and remitting taxes on rental income to the Canada Revenue Agency (CRA) is required. 

A non-resident of Canada who rents out their Canadian property, is subjected to a 25% tax withholding on the gross rental income. This amount must be remitted to CRA by the 15th of the following month after the rent payment is received.

Non-residents can choose to withhold 25% of gross rental income, and then file a return within two years to potentially claim a refund of all or part of the withheld amount, based on actual income and expenses incurred.

Another available option for non-residents is to withhold 25% income tax on the projected net rental income instead of the gross income. To do this, necessary documents must be submitted to the CRA, including Form NR6 and a corresponding expense sheet, before the first due rental payment. This process should be repeated each year the property is rented.

Eligible expenses for calculating the estimated net rental income may include condo fees, property taxes, mortgage interest, rental fees, repairs, and property insurance. If the estimated expenses exceed the estimated income, no remittance may be necessary, subject to CRA approval of the submitted Form NR6.

If the NR6 route is opted, please note that it requires the signature of the non-resident owner and a local/resident agent, typically your Toronto commercial property management company. Once completed, the form should be sent to the CRA for approval.

If opted to NR6, it is needed to adhere to certain filing requirements. Tax returns must be submitted by June 30 of the year following the rental year, using Tax Form Section 216. If tax owed is greater than the amount withheld, it’ll require the individual to pay the difference to the CRA. Conversely, if the amount withheld is more than the tax owed, the filer would receive a refund. However, if one taxes their file after the June 30 deadline, it’ll be taxed 25% of the gross rental income.
